“Platform” refers to the digital infrastructure, services, tools, and content delivery systems provided through xplex.

Account Creation

User-Generated Content

By posting content, you grant xplex a non-exclusive, worldwide, royalty-free, transferable license to use, host, display, and distribute such content solely for the purposes of operating, developing, and promoting the Services.

You are solely responsible for the content you upload and must ensure it does not violate any laws or infringe on any third-party rights.

Users are solely responsible for the legality and appropriateness of their content.

Acceptable Use

You agree not to use xplex to:

Post or transmit any unlawful, harassing, defamatory, or obscene content;
Violate the rights of others, including privacy, publicity, or intellectual property;
Interfere with or disrupt the Services or servers;
Attempt unauthorized access to any part of the Service, Platform or systems.

In-App Purchases and Subscriptions

xplex offers in-app purchases and subscription plans. By making a purchase, you agree to pay the specified fees and charges.

You can cancel your subscription at any time via your account settings. Cancellations will take effect at the end of the current billing cycle.

Intellectual Property

All content, trademarks, and data on xplex, including but not limited to text, software, code, designs, graphics, and logos, are the property of xplex and are protected by applicable intellectual property laws.

Users do not acquire any ownership rights to any content, trademarks, or other intellectual property belonging to xplex or its licensors.

Unauthorized use of our intellectual property is strictly prohibited.

Feedback and Suggestions

Any feedback, comments, or suggestions you provide to xplex may be used by us without any obligation to compensate you.

By providing feedback, you grant us the right to use it for any purpose.

Promotions and Contests

To the fullest extent permitted by law, xplex shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

(a) your use or inability to use the Service;
(b) any unauthorized access to or use of our servers and/or any personal information stored therein.

Force Majeure

xplex shall not be held liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, internet outages, government actions, or labor disputes.

Warranty Disclaimer

xplex provides its services “as is” and without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.

Changes to Terms and Conditions

xplex reserves the right to modify these Terms and Conditions at any time. We will provide notice of any changes by posting the new Terms and Conditions within the Service. We encourage you to review the Terms regularly. Continued use of xplex after changes implies your acceptance of the updated Terms.

Termination

xplex may suspend or terminate your access to the Services at any time, with or without cause or notice, including if you breach these Terms.
